Restraining Orders Lawyers

A restraining order, also called a protective order, is a legal order issued by a state court which requires one person to stop harming another.  In cases of domestic violence, restraining orders can be issued against the abuser to prevent further instances of domestic violence from occurring.  With domestic violence related restraining orders, the judge will sign a paper which will notify the abuser that they must stop the abuse or face serious legal consequences.  This will offer civil legal protection from domestic violence to people who have previously been victimized.

How a Restraining Order Can Help

There are a number of positive things that can come from getting a restraining order against someone who has formerly abused or threatened you.  A restraining order may:

  • Order the abuser not to threaten or hurt you
  • Order the abuser not to enter your residence
  • Give one parent temporary custody of children
  • Set a visitation schedule with minor children
  • Order the abuser to leave a shared residence
  • Grant you possession of important personal items
  • Grant you use of a vehicle
  • Order the abuser to go to counseling
  • Order the abuser to pay administrative court costs and fees, and to reimburse you for costs you incurred in bringing the action (attorney fees, etc.)
  • Order the abuser to do anything else you request that the judge approves.
